Terms & Conditions for ESI SMS/Text Messaging Service

By enrolling in or using the SMS/text messaging (“Service”) provided via ESI on this website, you (“You,” “User,” “Subscriber”) agree to be bound by these Terms & Conditions. If you do not agree to all terms, do not enroll or use the Service.
1. Eligibility & Consent
- You must be at least 18 years old and able to legally consent to receive SMS/text messages.
- By providing your phone number and opting in, you expressly consent to receive messages from A-List Home Care, LLC via ESI’s SMS platform for purposes such as service notifications, appointment reminders, care coordination, employment or recruitment updates, or other communications relevant to your inquiry.
- You acknowledge that consent is not required to receive services, and that opting in to SMS/text communications is voluntary.
2. Information Usage & Sharing
- Information you provide (including your phone number, name, care-related details, or employment-related data) may be used by A-List Home Care to determine your eligibility for services, coordinate care, respond to your requests, or for operational purposes.
- We will not sell, rent, or lease your SMS-collected information to outside parties, affiliates, or third parties.
- We may share necessary information with authorized personnel, contractors, or service providers (e.g., ESI, SMS platform providers) solely to deliver or support the messaging service under confidentiality obligations.
- We may disclose your information if required by law (e.g., court order, subpoena) or to protect our legal rights.
3. Message Frequency & Costs
- Standard message and data rates may apply, depending on your mobile carrier.
- The number of messages sent to you may vary (appointment reminders, alerts, follow-ups).
- You are responsible for any charges from your carrier.
4. Opt-Out / Unsubscribe
- You can opt out at any time by replying “STOP” to any message received. After opting out, you will no longer receive SMS messages (except perhaps a confirmation message).
- For help, you may reply “HELP” or contact us via alternative channels (phone or email).
- Following opt-out, we may retain minimal necessary information (e.g., your number, opt-out status) to prevent further messaging.
5. Termination & Changes to Service
- We reserve the right to suspend or terminate the SMS Service or your access to it at any time, with or without notice, for any reason (e.g., misuse, breach of these terms).
- We may revise or update these Terms & Conditions periodically. If material changes are made, we will provide notice via the SMS service or via other contact means. Continued use after changes constitutes acceptance.
6. Data Security & Retention
- We will use reasonable administrative, technical, and physical safeguards to protect information collected via SMS.
- We will retain your SMS-related data only as long as necessary for business, legal, or reporting purposes.
7. Disclaimers & Limitation of Liability
- The SMS Service is provided “as is,” without warranty of any kind (express or implied).
- We do not guarantee that messages will always be delivered, timely, or uninterrupted.
- In no event shall our liability exceed the amount you have paid to us (if any) in connection with the SMS Service, and we will not be liable for incidental, consequential, or punitive damages.
8. Governing Law & Dispute Resolution
- These terms are governed by the laws of Arkansas.
- Any disputes arising out of or related to these Terms shall be resolved in the courts located in Benton County, Arkansas, unless otherwise agreed in writing.
